Alrincon Terms of Service: Understanding Your Rights and Responsibilities

Welcome to alrincon.net ("alrincon," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and alrincon Network governing your access to and use of the alrincon website, mobile application, and related services (collectively, the "Service").

1. Acceptance of Terms

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Services

alrincon provides an online platform designed for adults (18 years or older) to connect, share interests (including photography), and build relationships. The Service includes profile creation, messaging, content sharing, community features, and other functionalities as described on the site.

Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are of legal age and have the right, authority, and capacity to enter into this agreement.

3. User Responsibilities

You are solely responsible for your conduct and any data, text, files, images, photos, or content ("User Content") you submit, post, or display on the Service. You agree to use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  1. Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  2. Harassing, abusing, threatening, or intimidating any other user.
  3. Posting or transmitting any content that is defamatory, obscene, pornographic, abusive, offensive, or otherwise objectionable.
  4. Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
  5. Interfering with or disrupting the Service or servers or networks connected to the Service.
  6. Attempting to gain unauthorized access to any portion of the Service, other accounts, or computer systems.
  7. Using any robot, spider, site search/retrieval application, or other automated device to retrieve or index any portion of the Service.
  8. Collecting or harvesting any information about other users without their express consent.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of alrincon Network and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

The "alrincon" name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of alrincon Network or its affiliates or licensors. You must not use such marks without the prior written permission of alrincon Network.

You retain ownership of the User Content you submit. However, by posting User Content, you grant alrincon a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALRINCON NETWORK, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE; AND
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT,

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Our total cumulative liability to you for all claims arising from or relating to the Service shall not exceed the amount you have paid us, if any, in the twelve (12) months preceding the event giving rise to the liability, or one hundred US dollars (USD $100), whichever is greater.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALRINCON NETWORK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
